Ottawa, ON – A coalition of civil society organisations released another explosive report on Parliament Hill, detailing how the government has continued to allow Canadian arms manufacturers to make hundreds of arms shipments via the United States that further enable Israel’s genocide of the Palestinian people. The report, Exposing the U.S. Loophole: How Canadian F-35 Parts and Explosives Reach Israel, details a massive systemic failure in Canadian export controls, confirming that Canadian components are directly incorporated into the F-35 fighter jets and the notorious 2000lb bombs being used in Israel’s genocide in Gaza.
The report also exposes – for the first time – Canada’s role as a vital trade corridor for hundreds of shipments of European-made TNT en route to US bomb-makers, as well as damning evidence of Canadian F-35 components being shipped on to Israel mere days after arriving at US facilities.
Despite the recent purported ‘ceasefire,’ the bombs have not stopped – Israel has continued its relentless bombardment and occupation of Gaza and ongoing campaign of assassinations, arrests, and displacements of Palestinians in the West Bank.
The central finding is simple: The government’s arms pause is a lie. It does not apply to the most critical flow of military goods—the high-value parts and explosives that travel mostly unregulated through the United States, allowing them to completely bypass Canadian export controls.
“Sending Canadian made weapons to Israel via the US is more than a policy loophole; it is complicity in genocide,” stated Rachel Small of World BEYOND War, who co-led the research efforts. “Our government told Canadians they had stopped the flow of arms. Our report proves that this claim is an outright lie. Canadian components are in the F-35 fighter jets and the bombs slaughtering Palestinians. So long as the US loophole is open, Canada is an active, undeniable participant in the unfolding genocide.”
The Engine of Complicity: F-35 Components and Explosives
The research traces the continuous, unregulated flow of hundreds of documented shipments of explosives and aircraft parts from Canadian factories and through Canadian ports to U.S. manufacturing hubs, and ultimately, to Israel.
Key facts unveiled in the report:
- F-35 Reliance: Israeli F-35 fighter jets, used extensively in the attacks on Gaza, rely on an ongoing flow of specialized Canadian parts. These components are essential for the warplanes to operate.
- Bomb Fuel: The report reveals that Canadian-manufactured explosives and components are making their way into U.S.-made munitions, including the devastating 2000lb bombs, before being transferred to Israel.
- A Global Pipeline of TNT: European TNT shipped through Canadian ports and highways to the US artillery factories supplying Israel’s bombs.
- The Loophole’s Design: The Export Control List regulation that under the Export and Import Permit Act exempts most military exports to the U.S. from Canadian permitting requirements has become a fatal loophole, which the government refuses to close, rendering its public arms pause pledges meaningless.
“Our findings confirm Canada’s direct complicity in the war and genocide,” said Haneen Ismail of the Palestinian Youth Movement. “The evidence shows that the government’s false claims and unenforceable pledges have enabled further atrocities. Instead of ending its role, the government has tried to hide it. Israeli military systems simply cannot operate without the Canadian supply chain.”
The Legislative Response: The ‘No More Loopholes’ Act
Following the press conference and the release of this detailed evidence, MP Jenny Kwan will debate the merits of her Private Member’s Bill, the “No More Loopholes Act” (C-233), in the House of Commons on Wednesday, November 19, 2025. This bill is the essential legislative remedy to the systemic failures exposed in this report.
The Act seeks to amend the Export and Import Permits Act to:
- Remove the U.S. Exemption: Close the fatal loophole by applying the same strict export control scrutiny and human rights risk assessment to military exports destined for the United States as it does to every other country.
- Ensure Transparency: Mandate enhanced annual public reports to Parliament on Canada’s compliance with the Arms Trade Treaty.
The Demand: A Comprehensive, Non-Negotiable Two-Way Arms Embargo
The coalition is demanding immediate and decisive action to restore Canada’s legal and moral standing:
- Impose a Full Two-Way Arms Embargo: Immediately halt the transfer of all military goods and technology to and from Israel, including via the United States.
- Support Bill C-233: All parties must immediately support and fast-track the passage of MP Kwan’s “No More Loopholes Act” to legally close the U.S. backdoor permanently.
- End the Deception: Provide full public transparency on all existing military export contracts and immediately cancel any that enable the war in Gaza.
The only way to genuinely and comprehensively end Canada’s complicity in the genocide is to immediately halt the flow of weapons and military components—both directly and indirectly via the U.S. loophole.

Le rapport, intitulé « L’utilisation de la faille américaine pour l’acheminement de pièces de F-35 et d’explosifs canadiens vers Israël », décrit en détail une défaillance systémique massive des mesures encadrant les exportations canadiennes, confirmant que des composants canadiens sont directement intégrés dans les avions de combat F-35 et les bombes notoires de 2 000 livres utilisées dans le génocide perpétré par Israël à Gaza.
Le rapport révèle également, pour la première fois, le rôle crucial joué par le Canada en tant que corridor commercial pour des centaines d’expéditions de TNT fabriqué en Europe à destination des fabricants de bombes américains, ainsi que des preuves accablantes montrant que des composants canadiens destinés aux F-35 ont été expédiés vers Israël quelques jours seulement après leur arrivée dans des installations américaines.
Malgré le récent « cessez-le-feu » supposé, les bombes n’ont pas cessé : Israël a poursuivi son bombardement et son occupation sans fin de Gaza, ainsi que sa campagne d’assassinats, d’arrestations et de déplacements de Palestiniens en Cisjordanie.
La conclusion principale est simple : la pause dans les ventes d’armes décrétée par le gouvernement est un mensonge. Elle ne s’applique pas au flux le plus critique de matériel militaire, à savoir les pièces de grande valeur et les explosifs qui transitent par les États-Unis, pour la plupart sans contrôle, ce qui permet de contourner complètement les lois canadiennes encadrant l’exportation.
« L’envoi d’armes fabriquées au Canada à Israël via les États-Unis est plus qu’une faille dans la politique ; c’est une complicité dans le génocide », a déclaré Rachel Small, de World Beyond War, qui a codirigé les efforts de recherche. « Notre gouvernement a dit aux Canadiens qu’il avait mis fin au flux d’armes. Notre rapport prouve que cette affirmation est un mensonge éhonté. Des composants canadiens se trouvent dans les avions de combat F-35 et les bombes qui massacrent les Palestiniens. Tant que la faille américaine restera ouverte, le Canada sera un participant actif et indéniable au génocide en cours. »
La réponse législative : la loi « Finies les failles »
À la suite de la conférence de presse et de la publication de ces preuves détaillées, la députée Jenny Kwan débattra du bien-fondé de son projet de loi d’initiative parlementaire, la « Loi Finies les failles » (C-233), à la Chambre des communes le mercredi 19 novembre 2025. Ce projet de loi constitue le remède législatif essentiel aux défaillances systémiques mises en évidence dans le présent rapport.
La loi vise à modifier la Loi sur les licences d’exportation et d’importation afin de :
- Supprimer l’exemption accordée aux États-Unis : combler cette lacune fatale en appliquant aux exportations militaires destinées aux États-Unis les mêmes contrôles stricts et la même évaluation des risques pour les droits humains que pour tous les autres pays.
- Garantir la transparence : exiger la présentation de rapports publics annuels plus détaillés au Parlement sur la conformité du Canada au Traité sur le commerce des armes.
La demande : un embargo complet, bilatéral et non négociable sur les armes
La coalition exige des mesures immédiates et décisives pour rétablir la position juridique et morale du Canada :
- Imposer un embargo total et bilatéral sur les armes : mettre immédiatement fin au transfert de tous les biens et technologies militaires à destination et en provenance d’Israël, y compris via les États-Unis.
- Soutenir le projet de loi C-233 : tous les partis doivent immédiatement soutenir et accélérer l’adoption du projet de loi « Loi Finies les failles » de la députée Kwan afin de fermer définitivement la lacune américaine.
- Mettre fin à la tromperie : assurer une transparence totale sur tous les contrats d’exportations militaires existants et annuler immédiatement ceux qui permettent la guerre à Gaza.
La seule façon de mettre véritablement et complètement fin à la complicité du Canada dans le génocide est de mettre immédiatement fin à l’acheminement d’armes et de composants militaires, tant directement qu’indirectement via la faille américaine.
